Terms & Conditions

Last updated: November 2026 · Monte Marketing (ABN 75 836 873 624)

These terms cover work done by Monte Marketing ("we", "us") for you — websites, bots, Monte Studio sites, MAS SEO, care plans and AI integrations. By engaging us or using our services you accept them.

Quotes and scope

Each job starts with a written scope (even a short one). Work outside the agreed scope is quoted before it's done — no surprise invoices. Estimates are estimates; we flag changes early.

Subscriptions (MAS, care plans, Studio hosting)

What we promise — and what we don't

Your responsibilities

Intellectual property

Once paid, the website content, design and code we produce for you are yours to keep. We retain the right to show the work in our portfolio. Tools we've built for reuse across clients (like MAS and Monte Studio themselves) remain ours — your site and its content never do.

Imported sites (Monte Studio)

You can import an existing site to review and edit inside Studio. Taking an imported site live on our hosting requires a published plan or a transfer we've approved — Studio isn't open hosting for arbitrary sites. We do this so every site we host is one we can genuinely support.

Australian Consumer Law

Nothing in these terms limits your rights under the Australian Consumer Law. If our services aren't delivered with due care and skill, you're entitled to a remedy — fix, resupply or refund as the law provides.

Liability

To the extent the law allows, our liability is limited to re-supplying the service or refunding what you paid for the affected period. We're not liable for indirect losses (like lost profits) arising from things outside our reasonable control.

Scope of Services and Acceptance

The terms and conditions set out on this page govern every engagement with Monte Marketing, whether you are based in Hervey Bay, elsewhere in Queensland, or anywhere else across Australia. By requesting a quote, signing a proposal, or otherwise confirming a project, you acknowledge that Monte Marketing will deliver the agreed‑upon custom web development, business bots, Monte Studio sites, MAS SEO, staff systems, or AI integrations exactly as described in the fixed‑price quote. All services are provided in plain‑English, with clear deliverables and timelines, and Monte Marketing retains the right to adjust the schedule only with your written consent. Any additional work beyond the original scope will be documented in a separate amendment, priced at the current rates, and will become part of these same terms and conditions once both parties sign off.

Payment, liability, and dispute resolution are also covered by these terms and conditions. Monte Marketing requires a 50 % deposit before work commences, with the balance due upon delivery of the final product or as otherwise specified in the quote. All fees are fixed; there are no hidden charges or surprise costs. Monte Marketing’s liability is limited to the amount paid for the specific service in question, and we are not responsible for indirect, consequential, or lost‑profit damages arising from the use of the delivered systems. If a disagreement arises, both parties agree to first seek an amicable resolution through good‑faith negotiation, and if that fails, to submit the matter to mediation in Queensland before pursuing any court action. These terms and conditions remain in effect until the contract is fully performed or mutually terminated in writing.

Your consumer rights

Nothing in these terms limits your rights under Australian Consumer Law. Our services come with guarantees that can't be excluded — services must be delivered with due care and skill, be fit for purpose, and arrive within a reasonable time. If we fail to meet those guarantees you may be entitled to a remedy under the ACCC's consumer guarantees. These terms explain how we work together; they never take away rights the law gives you.
